TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL JUSTLAB.AI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL) ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE USE OR INABILITY TO USE THE SERVICES, EVEN IF JUSTLAB.AI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL JUSTLAB.AI'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE AMOUNT PAID BY YOU TO JUSTLAB.AI FOR THE SERVICES DURING THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR $100, WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless JustLab.ai, its affiliates, officers, directors, employees, agents, and licensors from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms by you or any activity related to your account (including negligent or wrongful conduct).
We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.
You may terminate these Terms by canceling your subscription (if applicable) and discontinuing use of the Services.
Upon termination, your right to use the Services will immediately cease, and any fees paid by you are non-refundable.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which JustLab.ai is registered, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Services shall be resolved through good faith negotiations. If such negotiations do not resolve the dispute, either party may initiate binding arbitration in accordance with the arbitration rules of the jurisdiction in which JustLab.ai is registered.
These Terms constitute the entire agreement between you and JustLab.ai regarding the Services and supersede all prior and contemporaneous written or oral agreements.
The failure of JustLab.ai to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced to the fullest extent under law.
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign or transfer these Terms, at our sole discretion, without restriction.
We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
